Before you use our platform, we want to take a moment to speak plainly. These Terms and Conditions are not here to confuse you or bury important information in legal language. They exist to establish a clear, honest understanding between you and us — what you can expect from our services, what we expect from you, and how we handle situations that occasionally fall outside the usual path.
About Our Services
We provide an online platform that connects qualifying patients in San Jose, California with licensed California physicians for medical cannabis evaluations. Our role is to facilitate that connection and support the administrative process involved in applying for a physician’s recommendation and, if desired, the official Medical Marijuana Identification Card (MMIC) through Santa Clara County.
We are not a medical practice, a dispensary, or a cannabis retailer. We do not prescribe medication, and we do not guarantee approval for any applicant. The physician you are connected with through our platform makes all clinical determinations independently, based on their professional medical judgment and California law.
Eligibility to Use Our Platform
To use our services, you must meet the following requirements at the time of your application:
- You must be at least 18 years of age, or a minor whose parent or legal guardian is managing the application on your behalf
- You must be a current resident of California with valid proof of residency
- You must hold a valid California state-issued photo identification, such as a driver’s license or state ID card
- You must have a genuine medical condition that you believe qualifies under California’s Compassionate Use Act
By submitting an application, you confirm that the information you provide is accurate, complete, and truthful. Providing false or misleading information to obtain a physician’s recommendation is a violation of these terms and may constitute fraud under California law.
The Evaluation Process
When you complete the intake form and schedule a consultation through our platform, you will be connected with a California-licensed physician who will evaluate your medical history and current health condition. This is a real clinical evaluation, not a formality.
The physician will determine, based entirely on their independent medical judgment, whether medical cannabis is appropriate for your condition. We do not influence, pressure, or override physician decisions in any direction. If a physician determines that you do not qualify, that decision is final and is not subject to appeal through our platform.
If you are approved, you will receive a signed physician recommendation letter that is valid for use at licensed California dispensaries, including those throughout San Jose. This recommendation is valid for 12 months from the date of issuance.
Fees and Refund Policy
The consultation fee for your medical cannabis evaluation is clearly displayed on our platform before you submit payment. Fees typically range between $40 and $100 depending on the package selected. We offer a full refund if your application is not approved by the physician following your evaluation. If you are approved and receive your recommendation, the consultation fee is non-refundable, as the medical service has been fully rendered.
If you choose to pursue the official state MMIC through Santa Clara County, the county charges a separate application fee of up to $100, with a 50% reduction available to Medi-Cal beneficiaries. That fee is paid directly to the county and is governed by their own refund policies, which we do not control.
Any additional services, such as physical plastic card printing or expedited processing, are optional and carry their own clearly stated fees at the time of selection.
Accuracy of Information
You are solely responsible for ensuring that all information submitted through our platform is accurate, current, and complete. This includes your personal identification details, California residency documentation, and any medical history provided during the intake process.
If inaccurate information leads to a denial, a delay in processing, or a legal complication, we cannot be held responsible for those outcomes. We strongly encourage you to review your submission carefully before finalizing it.Physician Independence and Medical Disclaimer
Physician Independence and Medical Disclaimer
Every physician who conducts evaluations through our platform is independently licensed by the California Medical Board and operates under their own professional and ethical obligations. Their clinical decisions are theirs alone.
Nothing on this website constitutes medical advice. The information provided here is for general educational purposes and is not a substitute for consultation with a qualified healthcare professional. If you are experiencing a medical emergency, please contact 911 or visit your nearest emergency room immediately.
We also want to be transparent about one important legal point: California law prohibits the physician who issues your recommendation from being affiliated with or directing you to any specific cannabis dispensary. This protection exists for your benefit, and it is a standard we uphold without exception.
Legal Compliance
Medical cannabis in California is governed by the Compassionate Use Act (Proposition 215), the Medical and Adult Use Cannabis Regulation and Safety Act (MAUCRSA), and various Santa Clara County ordinances. By using our services, you agree to use any physician recommendation or MMIC card obtained through our platform in full compliance with all applicable California state and local laws.
You acknowledge that while medical cannabis is legal in California, it remains a Schedule I controlled substance under federal law. Our platform operates within the bounds of California state law, and we make no representations regarding federal legality or legal status in any other jurisdiction.
